08/07.04.2021 Learned counsel Mr. Hemant Kumar Shikarwar has entered appearance on behalf of the respondent through vakalatnama.

The appeal is directed against the dismissal of Original Suit No. 113 of 2012 instituted by the petitioner / appellant herein for decree of divorce on the ground of cruelty and desertion under Section 13(1) (i-a) (i-b) of the Hindu Marriage Act, 1955 by the impugned judgment dated 25.04.2018 and decree dated 05.05.2018 passed by learned Principal Judge, Family Court, Hazaribag.

Learned counsel for the parties agree that an effort can be made for amicable settlement of the matrimonial dispute through mediation at this appellate stage also before adjudication on merits. Parties come from Hazaribag and are ready to attend the mediation physically at JHALSA.

In that view of the matter and in spirit of the Family Courts Act, 1984, parties are directed to approach the learned Member Secretary, JHALSA on 19.04.2021 between 10.00 a.m. to 1.30 p.m. He can also be approached through the following cell number:

2. 8986601912 On their approaching the matter be placed before the learned Mediator, JHALSA for undertaking the exercise. Appellant husband shall pay Rs. 1000/- as travelling and incidental expenses to the respondent wife on each date she attends the mediation, in presence of the learned Mediator, JHALSA. Both the parties are expected to cooperate in the mediation process with open mind and attend each of

the sittings. In case they are able to arrive at an amicable settlement of their dispute, the terms and conditions be reduced in writing under their joint signature and be submitted along with the report 4 weeks thereafter.

Matter be listed on reopening after the Summer Vacation, 2021 along with the report.
