Mr. Shailesh Kumar Sinha, the learned APP appears for the State.

2. The petitioner is aggrieved of the order dated 11.02.2016 passed in Sadar PS Case No.1016 of 2012 corresponding to G.R No.4989 of 2012 by which his discharge petition has been rejected.

3. Mr. Shailendra Jit, the learned counsel for the petitioner states that the petitioner has now deposited the entire loan amount and the opposite party-bank has issued the requisite certificate in favour of the petitioner.

4. In view of the subsequent developments, the learned counsel for the petitioner seeks permission to withdraw this criminal revision petition to enable the petitioner to file compromise petition in the Court below for quashing of the entire criminal proceedings.

5. Accepting the prayer made on behalf of the petitioner for withdrawal of this criminal revision petition, Criminal Revision No.341 of 2016 is dismissed as withdrawn.

6. However, it is made clear that this Court has not expressed any opinion on the merits of the matter and the compromise petition filed by the parties shall be dealt with by the Court concerned in the light of the

judgment of the Hon'ble Supreme Court in "Gian Singh v. State of Punjab" (2012) 10 SCC 303 and other cases.

7. Let a copy of the order be transmitted to the Court concerned through "Fax".
