Notice in the aforesaid terms.

The present application has been filed by the

applicant for the suspension of judgment of conviction and order

of sentence dated 27.02.2025 as imposed by the learned Judicial

Magistrate, First Class, Rajgarh, District Sirmaur, whereby, the

applicant has been ordered to undergo simple imprisonment for

a period of one year and compensation to the tune of

Rs.1,50,000/- has been awarded against the applicant. The

judgment of conviction and order of sentence was affirmed by

the learned Sessions Judge, Sirmaur District at Nahan vide

judgment dated 05.01.2026.

Perusal of grounds of petition reveals that the

applicant has made out arguable points in the case and the

revision shall take sometime for its final disposal. Therefore, it is

ordered that during the pendency of the present petition the

execution of judgment of conviction and order of sentence as

passed by the learned Judicial Magistrate, First Class, Rajgarh,

.

District Sirmaur in Complaint No.70/3 of 2021 titled Punjab

National Bank vs. Vijay Kumar on 27.02.2025 and affirmed by

the learned Sessions Judge, Sirmaur District at Nahan in CIS

Case No.115 of 2025 on 05.01.2026, is ordered to be suspended

subject to the following conditions:

of "(i) That the applicant shall furnish personal bond in the sum of Rs.50,000/-, along with rt one surety of the like amount, to the satisfaction of the learned trial Court, within a period of four weeks from today, with an undertaking that he will surrender before the

learned trial Court to serve the remainder substantive sentence, in case of ultimate dismissal of the present revision, by this Court;

(ii) That the applicant shall deposit 30% of the total amount of compensation, which has been referred to by the learned trial Court as fine, with the learned trial Court,

within a period of eight weeks from today, which shall be in addition to the amount, if

not, already deposited by the applicant.

(iii) The applicant shall not leave the territory of India without the prior permission of the

Court."
