Kahan Chand vs. State of H.P.
CWP No. 2140 of 2016
22.10.2024 Present: None for the petitioner.
Mr.Pawan K. Nadda, Additional Advocate General, for respondent-State.
Compliance affidavit in terms of judgment dated
31.07.2024 has not been filed nor any application or request
is pending for extension of time for compliance by assigning
genuine reasons for that. Therefore, non-implementation/
defiance of order appears to be deliberate, willful and
intentional. The concerned Officer, for defiance of order
passed by Court, is liable to face the proceedings
accordingly.
However, before initiating such proceedings, as
persuasively prayed by learned Additional Advocate General,
one more opportunity is granted to the respondents to
ensure compliance of judgment and to file affidavit
accordingly on or before 30.11.2024 failing which adverse
order shall follow.
List for compliance on 04.12.2024.
(Vivek Singh Thakur), Judge.
(Bipin C. Negi), Judge.
