1. After arguments were heard, learned counsel

appearing for the appellant sought to withdraw the appeal with a

caveat.

2. The only plea that the appellant wishes to press

concerns waiver of costs of Rs.10,000/- imposed by the learned

Single Judge.

3. Having regard to the submission of the learned

counsel for the appellant, the appeal is dismissed as not pressed

in relation to merits of the case. However, the impugned

judgment dated 11th September, 2024, passed by the learned

Single Judge is varied to the extent it imposes costs. That part of

the impugned judgment would stand excised.

4. Pending applications, being CMP Nos.18423 &

18424 of 2024, also stand disposed of.
