By way of instant application, prayer has been made by the applicant/respondent, for release of the balance
award amount lying deposited in the Registry of this court.
Prayer made in the instant application has been opposed by the non-applicants/appellants on the ground that department is contemplating to file SLP against judgment dated
24.4.2023, whereby appeal bearing RFA No. 234 of 2017, having been filed by the non-applicants/appellants came to be
dismissed on 24.4.2023. In the reply to the application, though it has been averred that department is contemplating to file
SLP, but no document has been placed on record suggestive of the fact that steps, if any, have been taken by the department
to file SLP. Since statutory period of filing the SLP has already expired, this Court sees no impediment in accepting the prayer having been made by the applicant for release of award amount lying deposited in the Registry of this Court and accordingly, the application is allowed and Registry is directed to release the balance award amount in favour of the applicant alongwith up- to-date interest, by remitting the same in his saving bank account strictly as per his share, detail whereof is mentioned in para-3 of the application, subject to verification by the Accounts Branch. Application stands disposed of.
