Mr. Pratush Sharma, Additional Advocate General with Mr. Gautam Sood, Ms. Priyanka Chauhan and Mr. Rahul Thakur, Deputy Advocate Generals, for

the respondents.

Compliance affidavits have been filed. It is submitted

that the judgment passed by this Court is going to be implemented

subject to the rights of the State in pending SLP (s), if any, before

the Hon'ble Supreme Court. It is undertaken that the actual

benefits to all the petitioners will be released well before 31st

December, 2023.

Learned counsel for the petitioner has informed the

Court today that out of the seven Special Leave Petitions filed by

the State, six have already been dismissed by Hon'ble Supreme

Court.

The judgment was passed by a Division Bench of this

Court on 2nd March, 2023, more than nine months have elapsed

and petitioners have not been able to reap the benefits of the

judgment till date without there being any stay on the

implementation thereof.

The matter has already been delayed beyond

justifiable period.

In these circumstances, there is no further justification

to allow the respondents to take further period of two months for

implementing the judgment. Keeping in view the entirety of facts

and circumstances, the respondents are directed to implement the

judgment in letter & spirit within fifteen days from today.

List on 20.11.2023, on which date compliance

affidavit shall be filed.
