Respondent-State has filed status report and HC

Jasbir Singh has come present alongwith the record. Having

perused the status report, this Court finds that 47 prosecution

witnesses out of total 79 witnesses stand examined and for

examination of remaining witnesses, Court has already fixed the

matter on 13.12.2023, coupled with the fact that petitioner is

accused of having committed serious offence punishable under

Section 302 of IPC, this Court is not inclined to consider the prayer

made on behalf of the petitioner at this stage.

2. Faced with aforesaid situation, learned counsel

representing the petitioner seeks permission to withdraw the

present petition at this stage with liberty to file afresh, if required

and desired.

3. Accordingly, in view of the above, the present petition

is dismissed as withdrawn with liberty as prayed for. However,

having taken note of the fact that the petitioner is behind the bars

for more than five years, coupled with the fact that only 29

of prosecution witnesses remain to be examined, this Court hopes

and trusts that Court below would make all out efforts to conclude

the trial expeditiously. Otherwise also, it has been already made rt aware to all Courts on the administrative side that jail appeals as

well as cases of under trial are required to be heard and decided

on priority basis.
