CMP No.8679 of 2023

By way of this application, the appellant-

applicant has prayed to effect service of respondent No.2,

Shri Naresh Kumar, through substituted mode of service.

As per the contents of the application, the

aforesaid respondent cannot be served by way of ordinary

process, as he is evading his service deliberately.

Considering the factual position, as mentioned

in the application, which is duly supported by an affidavit,

this Court is satisfied that respondent No.2 cannot be

served by way of ordinary process, as such the application

under consideration is allowed.

Let notices of the present appeal be issued

against respondent No.2, Shri Naresh Kumar, by way of

publication in newspaper, "Amar Ujala" (Una Hamirpur

Edition), returnable for 11.10.2023. Requisite steps be

taken within ten days from today. The publisher is

directed to forward the printed material, under postal

certificates, to respondent No.2 on the given address and

submit the proof of the same to this Court. The application

is, thus, disposed of.

Since, the main appeal has been admitted for

hearing, disposal whereof will take sufficient long time, as

such, during the pendency of the main appeal, the

operation of impugned judgment and decree dated

6.9.2018 passed by learned Additional District Judge-II,

Una, H.P in Civil Appeal No. 97/2016 titled as Raghav

Puri vs. State of H.P. is ordered to be stayed.

rIt is clarified that during the pendency of the

present appeal, the appellant is also restrained from

recovering any amount as per order dated 11.8.2016

passed by the Court of Sub Divisional Collector, Una in

Case No.01/2015/S.A titled as State of H.P. Vs. Raghav

Puri.

CMP(M) No.172 of 2019

This application has already been disposed of

on 5.3.2022.
