By way of instant application, the applicant-petitioner

has prayed for suspension of sentence.

I have heard learned counsel for the appellant-

applicant as well as learned counsel for the respondent and have

also gone through the material available on record. Learned

counsel for the appellant-applicant stated at bar that the applicant

was released on bail during the pendency of the trial before the

Court below.

As the main case has been admitted for final hearing, it

is ordered that the substantive sentence imposed upon the

applicant-petitioner, vide judgment of conviction and order of

sentence dated 14.06.2023 passed by the learned Special Judge,

CBI, Shimla, District Shimla, H.P., in Corruption Trial No. 3-S/7 of

2017, shall remain suspended, till final disposal of the appeal,

however, subject to the applicant's depositing fine amount, if not

already deposited and also furnishing personal bond in the sum of

Rs.50,000/- with one surety in the like amount to the satisfaction of

learned trial Court, within a period of four weeks from today,

undertaking therein to appear in the Court as and when directed

.

and in the event of the dismissal of the appeal, the applicant will

surrender before the Court to undergo sentence, if any, imposed

by the Court.

Application stands disposed of.
