By way of instant application, prayer has been made on
behalf of the petitioner-accused for extension of time to comply with
order dated 20.10.2022 passed by this court, whereby a direction was
issued to the petitioner-accused to pay 25% of compensation amount in
lieu of suspension of sentence, within two months, from the date of
order. Since on account of financial crunch, petitioner-accused was
unable to comply with the aforesaid order within the time stipulated
therein, petitioner has approached this court in the instant proceedings,
for further extension of time
For the reasons stated in the application, the same is
allowed. Further one week's time from today is granted to the
petitioner/accused to deposit 25% of compensation amount within a
period of one week, as ordered by this Court vide order dated
20.10.2022, failing which interim protection granted in favour of the
petitioner shall come to an end and the respondent/non-applicant shall
be at liberty to get the judgment of learned trial Court executed in
accordance with law. However, till expiry of the time granted by this
Court, respondent shall not take steps for execution of the judgment of
conviction and order of sentence passed by learned trial Court, which is
under challenge before learned court below.
Application stands disposed of.
