Ramesh Chand Vs. Sandeep Kumar and anr.
COPC No. 388 of 2022
.
04.01.2023 Present: Mr. Ashok Kumar, Advocate, for the petitioner.
Mr. Ajay Kumar Chauhan, Advocate, for the
respondents.
CMP No. 193 of 2023
An application has been moved seeking exemption of
respondent from personal appearance from today and also for ex-
tension of time in complying with the judgment of this Court.
It is submitted that respondent is presently at
Dharamshala in relation with the ongoing Vidhan Sabha Session
and therefore, is not in a position to appear before this Court today.
For the reasons stated, the prayer for exemption is allowed.
As regards the prayer for extension of time, there are
no plausible reasons. The judgment was passed by a Division
Bench of this Court on 18.08.2022. Respondent had got sufficient
time to implement the judgment. In fact, the judgment dated
18.08.2022 is based upon a previous judgment dated 29.11.2021
passed by a Division Bench of this Court. Though, there are no
reasons to extend the time, however, as a matter of indulgence,
one last opportunity is afforded to the respondent to comply with
the judgment and file the compliance affidavit on or before the
next date positively, failing which respondent shall remain present
before this Court to answer the contempt.
List on 14.03.2023.
