                                                               ORDER

1. Rule. Learned APP waives service of notice of rule for respondent - State of Gujarat.

2. By way of the present petition, the petitioner has prayed to release him on parole leave on the ground that his brother-in- law was expired and to perform the post-death rituals, his presence would be required. In support of it, necessary documents are produced on record.

3. I have heard learned advocates appearing for the parties and have also perused the documents produced along with the petition as well as considered the averments made in this petition including jail remarks. It is found that the petitioner has undergone period of imprisonment of 12 years and more

particularly keeping in mind that the brother-in-law of the petitioner was expired, to perform the post-death rituals, the application is required to be considered. Therefore considering the grounds mentioned and the averments made in the petition, the present petition deserves to be allowed.

4. Therefore, the present petition stands allowed partly. The petitioner prisoner is ordered to be released on parole leave for a period of 14 days from the date of his actual release, on executing personal bond of Rs.5,000/- (Rupees Five Thousand) before the Jail authority and on usual terms and conditions as may be imposed by the Jail Authority.

5. The petitioner shall surrender before Jail Authority on completion of parole leave, without fail.

6. Rule is made absolute to the aforesaid extent. Registry to communicate the present order to the concerned jail authority forthwith.
