                                                         ORAL ORDER

1. Rule. Learned APP Mr. Rohan N Shah waives service of notice of rule for respondent - State of Gujarat.

2. By way of the present petition, the petitioner has prayed to release him on parole leave on the ground that the applicant's nephew has expired on 18.04.2026 and he has to attend the Chalishma ceremony. In support of it, necessary documents are produced on record.

3. I have heard learned advocates appearing for the parties and have also perused the documents produced along with the petition as well as considered the averments made in this petition including jail remarks. It is found that the applicant is

in jail since more than 11 years and as per the jail report, he was released lastly on 18.12.2025 to 07.01.2026 and has surrendered all the time whenever he was released and coupled with the fact that the ground urged before this Court with regard to the death of his nephew, appears to be justified. Therefore, considering the grounds mentioned and the averments made in the application, the present application deserves to be allowed.

4. Therefore, the present application stands allowed partly. The applicant-prisoner is ordered to be released on parole leave for a period of 14 days from the date of his actual release, on executing personal bond of Rs.5,000/- (Rupees Five Thousand) before the Jail authority and on usual terms and conditions as may be imposed by the Jail Authority.

5. The petitioner shall surrender before Jail Authority on completion of parole leave, without fail.

6. Rule is made absolute to the aforesaid extent. Registry to communicate the present order to the concerned jail authority forthwith.
