behalf of Mr. Ronith Joy, learned Advocate for the applicant.

2. At the outset, Mr. Kurian, learned Advocate, under the

instructions of his client, does not press the present application,

with a liberty to file an application under Section 528 of the

Bharatiya Nagarik Suraksha Sanhita, 2023, as cognizance has

been taken by the Court.

3. The permission as sought for is granted.

4. It is made clear that this Court has neither gone into nor

examined the merits of the matter.

5. It is open for the petitioner to file an appropriate application

2023 before the appropriate Court, as prayed.

6. With the aforesaid liberty, the present application stands

disposed of as withdrawn. Notice is discharged. No order as to

costs. Interim relief, if any, stands vacated forthwith.
