ORDER IN FIRST APPEAL NO.5117 OF 2008

Ms. Agneya Mankad, learned Assistant Government Pleader, appearing on behalf of the appellant State has submitted that she has received written instructions from the concerned authority to withdraw the present First Appeal, as the acquiring body has also preferred First Appeal being No.332 of 2008 against the judgment and award passed by the Reference Court, Godhra in Land Acquisition Reference No.154 of 1993 and, therefore, seeks permission to withdraw the present appeal.

Considering the above submissions, permission, as sought for, is granted. First Appeal No.5117 of 2008 stands
