1. At the outset, Mr. H.S. Munshaw, learned advocate
appearing for opponent No.1, has submitted that the Special
Leave Petition (Civil) Diary No.39308 of 2025, preferred against
the judgment and order dated 19.09.2024 passed in captioned
appeals, has been dismissed by the Supreme Court by order
dated 25.08.2025. It is submitted that in case of 17 employees, the
respondent - Corporation has already passed an order in favour of
the employees. It is submitted that, thus the judgment and order
passed by this Court is implemented and accordingly, all the
employees will be paid benefits as directed by this Court, as the
SLP is dismissed.
2. Under the circumstances, we dispose of the present
proceedings with a direction to the respondent - Corporation to
pass necessary orders and confer the actual benefits to the
present applicants within a period of 6 weeks.
3. We clarify that, in case, there is any error in calculation of the
arrears, it will be open for the applicants to file appropriate
application before the appropriate forum. We further clarify that, in

case, no orders are passed or no benefits are paid within the time
specified by us, it will be open for the applicants to revive the
present applications by filing a simple note before the Registry. It is
also clarified that, in case, the applicants are constrained to revive
the present applications, for want of any order for grant of benefits,
cost of Rs.25,000/- (Rupees Twenty Five Thousand), shall be
imposed in each of the captioned applications, upon the erring
officer.
Registry is directed to place a copy of this order, in each of
the captioned connected matter(s).
