Learned advocate Ms. Kirti Pathak appearing for the appellant- Insurance Company has assailed the impugned judgment and award on the ground raised in the appeal memo, however, noticing the challenge involved, this Court is not inclined to entertain the appeal solely on the issue of smallness of the amount involved. Hence, present appeal is dismissed solely on the ground of smallness of amount involved. It is clarified that this Court has not gone into the merits of the case. The dismissing of the present appeal shall not have any bearing in so far as legal issue which may be raised by the Insurance Company in appropriate matter.

With these observations, present First Appeal as well as Civil Application stands disposed of.
