Mr. Neeraj Sharma, learned Additional Public Prosecutor

appearing for the State - applicant states at the bar that Sessions

Case No. 23 of 2015 is concluded by judgment and order dated

08.02.2018 passed by the 2nd Additional Sessions Judge, Bharuch,

whereby the respondent is convicted for the offences under Section

376 of the Indian Penal Code and is directed to undergo sentence of

rigorous imprisonment for a period of ten years and fine of

Rs.5,000/-.

The present application is filed by the State applicant

challenging the order dated 05.03.2016 passed below Exhibit-18 in

Sessions Case No. 23 of 2015, whereby the learned Sessions Judge

has rejected the application for placing further documents on record.

In view of the statement made by Mr. Neeraj Sharma, learned

Additional Public Prosecutor appearing for the State - applicant that

now with the conclusion of the trial being Sessions Case No. 23 of

2015, the present application would not survive.

In view of the aforesaid, the present application stands

dismissed as having rendered infructuous. Rule is discharged.
