The applicant-District Development Officer, District Panchayat, Junagadh, has filed this Civil Application seeking prayer to grant it Leave to Appeal. The applicant is desirous to prefer the Letters Patent Appeal against judgment and order dated 20.07.2023 of learned single Judge, whereby the Special Civil Application was allowed.

2. The case of the applicant is inter alia that learned single Judge granted the benefit of one increment to the number of employees through the petitioner-union. Revised pensionary benefits are also granted.

3. It was stated that the beneficiary-employees were the employees of

the applicant-Panchayat, however, the applicant-the employer was not joined as a party respondent in the proceedings of the writ petition.

4. In the facts of the case, it could be said that the applicant has litigative as well as appeallable interest in the subject matter.

5. Leave to Appeal deserves to be granted. The application is allowed in terms of prayer 4(B).
