                               ORAL ORDER

Learned advocate Mr. Nilay Patel for the petitioner could not follow the order passed in CMA No.27 of 2016 and could not pay the amount of Rs.1000/- towards cost within a week from 27.4.2017, the date on which the judgment was pronounced.

Regular Civil Suit No.28 of 2009 came to be dismissed for default. Therefore, an application was filed for condonation of delay in preferring application for readmission of the Regular Civil Suit. The learned 3rd Addl. District Judge, Veraval allowed the condonation of delay application with an order of paying Rs.1000/- to be paid within a week from that order. However, the petitioner has missed the time and therefore, the DLSA, Veraval did not accept the amount of cost. Therefore, the petitioner is before this Court.

Having heard learned advocate Mr. Nilay Patel for the petitioner and learned AGP Mr. Davda, time to deposit amount of cost of Rs.1000/- is enlarged upto 4.10.2023. If such amount of cost is deposited within the stipulated time with the DLSA, Veraval, order passed in CMA No.27 of 2016 shall come in force.

With above observations and directions, present petition stands disposed of. Notice discharged. Direct service is permitted today.
