1. Heard learned Advocate Mr. Dhaval Shah for the applicant and learned advocate Mr. Akash Patel for the respondents.

2. By way of this application, the applicant prays for condoning the delay of 135 days, which has occurred in challenging the judgment and order passed by the learned Principal Senior Civil Judge, Modasa, Aravalli in Special Civil Suit No. 4 of 2013 dated 03.02.2022.

3. Considering the submissions made by the learned advocate for the applicant and having regard to the averments on record, sufficient cause is being made out for condoning the delay, the same stands condoned. The present application stands allowed. Registry to list First Appeal on 15.03.2023.
