Heard learned AGP Mr. Trupesh Kathairiya on behalf of the applicant-State and learned Advocate Mr. K.M. Sheth on behalf of the respondent No.1.

By way of this application, the applicant seeks to condone delay of 68 days which has occurred in preferring First Appeal against the judgment and order dated 30.07.2021 passed by the learned Principal Senior Civil Judge, Vadodara in Land Reference Case No. 26 to 29 of 2016.

Considering the submissions made by learned AGP and having regard to the averments on record the delay has been satisfactorily explained, hence, the same is hereby condoned. Rule is made absolute.
