ORAL ORDER
This application is for condoning the delay of 684 days in preferring the appeal against the judgment and order dated 12.10.2018 in Atrocity Sessions Case No.21 of 2016 by the 5 th Additional Sessions Judge, Gondal, by which the applicant has been convicted for the offences under the Atrocities Act.
Learned advocate for the applicant has drawn attention of this Court to the contents of paragraph-3 indicating the explanation for delay. Learned advocate submitted that immediately upon the recording of the conviction, the applicant is in custody and is undergoing the sentence. The Court finds that the delay has been sufficiently explained and that the applicant still continues to be in jail.
In view of the aforesaid, the delay of 684 days in preferring the appeal is hereby condoned. Registry to list the appeal and application on 17th March 2023.
