(PER : HONOURABLE MR. JUSTICE A.J.DESAI) Though served, respondents has chosen not to appear before this Court.

Present application under Section 5 of the Limitation Act has been filed with a request to condone the delay of 249 days caused in filing the First Appeal against the common judgment and award dated 10.04.2019 passed by the learned Reference Court i.e. learned Additional Senior Civil Judge, Borsad in Land Acquisition Reference Cases.

Having heard learned AGP Mr. Bhargav Pandya appearing on behalf of the applicants - State Authorities and considering the averments made in the application in support of the prayer to condone the delay and as the delay has been sufficiently explained, present application is allowed. Delay caused in filing the First Appeal is hereby condoned. Rule is made absolute accordingly.
