1) We have heard Mr. D.K.Puj, the learned counsel appearing for the appellant (Org. Plaintiff) and Mr. Dhiraj M. Patel, the learned counsel appearing for the respondents (original defendants).

2) This appeal at the instance of the appellant (Org. Plaintiff) is directed against the judgment and decree passed by the Additional City Civil Judge, Court No. 30, Ahmedabad, in the Civil Suit No. 6105 of 2000, by which the suit filed by the plaintiff for injunction came to be dismissed.

3) During the pendency of this first appeal, the parties have been able to arrive at some amicable settlement. In such circumstances, Mr. Puj, the learned counsel for the appellant has instructions from his client, not to pressed this first appeal and

withdraw the same.

4) This first appeal is accordingly disposed of as not pressed without expressing any opinion on the merits of the case. If the parties have entered into a some sort of settlement and said settlement has been reduced into writing, duly signed by the parties then the parties shall abide by such settlement.

5) The connected civil application would also not survive and the same is disposed of.
