Though served, none appears for the respondents.

Learned advocate Mr.Pahwa appearing for the petitioner has submitted that the petitioner is facing the proceedings of Complaint No.9/2021 filed by the respondents and the next date is 21.10.2021. It is submitted that the aforesaid complaint is filed before the Government Labour Officer, Bhavnagar and a notice has been issued on such complaint to the petitioner and hence, an opportunity may be given to the petitioner so that he can take adjournment before the Labour Commissioner, Bhavnagar.

Since no one has appeared on behalf of the respondents, it will be open for the petitioner to seek adjournment in the proceedings vide Complaint No.9/2021 and the Labour Commissioner, Bhavnagar shall pass appropriate orders adjourning such complaint since the impugned judgment and order dated 18.03.2021 passed by the Presiding Officer, Industrial Tribunal, Bhavnagar in Reference (IT) No.98/2016, is under examination before this Court in the captioned writ petition.

The matter is kept on 25.11.2021.
