Mr.Barot, learned AGP seeks permission to delete deceased-respondent as her legal heirs has already on record. Permission as prayed for is granted. The respondents stands deleted from the array of the respondents.

The present application under Section 5 of the Limitation Act is preferred to condone the delay which has occurred in preferring First Appeal to assail the impugned judgment and order.

Considering the averments made in this application, the delay is condoned. The application stands disposed of. Rule is made absolute.
