This Civil Application is under Order XXII Rule 4 of the Code of Civil Procedure for bringing legal representatives and heirs of sole appellant on record of the First Appeal. The appellant - original claimant had expired subsequent to the passing of judgment and award and before the appeal is preferred in this Court. However, said appeal is filed in delay and according to the submission of Mr.Kunal Shah, learned advocate for the applicant, delay is already condoned. However, Registry is directed to verify the same.

Since the appellant - original claimant had died subsequent to the judgment and award and prior to filing of the appeal, the heirs and legal representatives of Tilva Harji Nananji is

ordered to be brought on record as mentioned in the cause title on record of filing First Appeal and Civil Applications arising therefrom.
