IA ORDER

1. This is an application for suspension of sentence pending appeal.

2. The applicant is convicted by the 7 nd Additional Sessions Judge, Surat, vide judgment dated 24.11.2020 in Special (POCSO) Case No.225 of 2017. The conviction is under Sections 8 and 10 of the Protection of Children from Sexual Offences Act, 2012. By the said judgment, the applicant is ordered to undergo rigorous imprisonment for a period of five years. Fine is also imposed and in default thereof, simple imprisonment is also imposed.

3. The appeal is admitted by this Court vide order dated 21.12.2020.

4. After arguing the matter for some time on suspension of

sentence, when the Court was not inclined, learned advocate for the appellant / applicant seeks permission to withdraw this application.

5. Permission as prayed for is granted. This application is dismissed as withdrawn. Rule is discharged.
