1. RULE. Mr.S. K. Bukhari, learned advocate waives service of notice of rule on behalf of respondent No.1, Mr.Trupesh Kathiriya, learned AGP waives service of notice of rule on behalf of respondent No.2 and Mr.A. A. Zabuawala, learned advocate waives service of notice of rule on behalf of respondent No.3.

2. The present application is for condonation of the delay of 59 days occurred in filing the above-mentioned Letters Patent Appeal against the judgment and order dated 04.07.2019 passed by the learned Single Judge in Special Civil Application No.14655 of 2011.

3. Having heard learned advocates appearing for both the sides and considering the explanation given in the application, the Court finds that the sufficient cause is made out to condone the delay.

4. In view of the above, the application is allowed. The delay occurred in filing the Letters Patent Appeal is condoned. Rule is made absolute.
