Learned advocate for the applicant requests to dispose of

present application with a liberty to approach before the court

of learned Judicial Magistrate First Class for the same prayer

whichever made by the applicant in the present application as

per the judgment of Hon'ble Apex Court reported in (2008)2

SCC 409 under the provisions of Section 156(3) of the Code of

Criminal Procedure.

Accordingly, present application stands disposed of with

aforesaid liberty.
