1. Heard Ms.Shivani Trivedi, learned counsel for the applicant.

2. By means of this application certain directions have been prayed for which may be in the nature of modification in the judgment and order dated 02.03.2016 by which a group of Sepcial Civil Applications were decided including the present Special Civil Application in which the present Civil Misc. Application is moved.

3. In our considered opinion, the Division Bench in its judgment dated 02.03.2016 granted liberty to the parties to file a fresh proceeding as may be advised as contained in paragraph­19 thereof, the present application for direction shall not be maintainable.

C/SCA/7008/2015 IA ORDER

The appropriate course open to the applicant would be to initiate fresh proceedings in case any of the directions are not complied with or any fresh cause of action has arisen.

4. The application is accordingly dismissed with observations made above.
