                            ORAL ORDER

1. The present Application has been filed by the applicant­ convict through Jail contending that he is in jail since last 8 years and 1 month as he has been convicted and sentenced for life imprisonment in Sessions Case No. No.88/2012 by the City Sessions Court No.10, Ahmedabad vide judgment and order dated 20.2.2013.

1.1 It is contended by the applicant that he has preferred application for his 5th furlough leave to the authority however, the same is pending before the concerned authority.

2. Heard Ms. Moxa Thakkar, learned APP for the respondent State through Video­conferencing.

3. Now, as per the jail remarks, especially Col­22, the application of the convict for his 5th furlough is pending before the concerned authority. In view of the same, the

concerned authority is directed to decide the same in accordance with law within one month from today.

4. In that view of the matter, the concerned authority is directed to decide the application of the applicant which was been sent by the jail authority vide letter No.4877/19 dated 16.11.2019 in accordance with law.

5. In case any adverse order is passed against the applicant, he can take necessary legal recourse which includes filing of proper application before this Court.
