ORAL ORDER
Heard learned advocate Mr.K.K. Thakkar for the applicants. Though Rule served, but non appears.
By way of the present application, the applicant has prayed for condonation of delay of 227 days occurred in filing the First Appeal.
Learned advocate for the applicant has stated that the impugned judgment and award was passed by the Tribunal on 28.02.2019. It has further stated that the certified copy of impugned award was delivered on 08.04.2019. It is submitted by the learned advocate for the applicant that the applicant was financially distressed due to hand mouth conditions and he had no sufficient money to pay the court fees for filing the appeal.
Accordingly, the delay of 227 days which has occurred in instituting the first appeal is condoned. The civil application is allowed. Rule is made absolute.
