1. Heard learned counsel Mr. A. M. Ahmed for the petitioner Renuka Sarma who has filed this application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for transit anticipatory bail enabling her to appear before the concerned Investigating Officer and co-operate with the investigation Page No.# 2/3
in Jalgaon Cyber Police Station and in connection with a case registered as Jalgaon Cyber Case No. 0004/2025 under Sections 318(4)/336(3)/3(5) of the BNS, 2023 R/W Section 66(D) of the IT Act.
2. Heard Mr. K. K. Parashar, learned Additional Public Prosecutor for the respondent State, and he has accepted notice.
3. I have considered the submissions at the Bar with circumspection.
4. It is submitted on behalf of the petitioner that she is a married woman with two children aged 5 years and 9 years. She is willing to co-operate with the investigation. The aforementioned case is under investigation.
5. The allegation against the petitioner is that she is involved in cyber crime and she has siphoned of an amount of Rs. 7,25,000/- out of a total amount of Rs. 31,56,064/-. It is submitted that the petitioner has not received the entire amount of Rs. 31,56,064/-.
6. The allegation is that Rs. 7,25,000/- has been transferred to her account by defrauding the complainant who is a resident of Jalgaon, Maharashtra.
7. The petitioner has received notice under Section 35(3) of the BNSS. As she has received the notice, she is willing to appear before the concerned Arresting Authority and co-operate with the trial.
8. After considering the submission that the petitioner is willing to co-operate with the trial, it appears that she may be granted transit bail.
9. Thereby, the petitioner is directed to appear before the concerned Investigating Officer within 25 (twenty five) days on or before 16.06.2026 and co-operate with the investigation.
10. Considering the entire aspect of the matter, it is directed that in the event of Page No.# 3/3
the arrest of the petitioner in connection with the aforesaid cases, he shall be released on transit bail on executing a personal bond of Rs.50,000/- with two sureties of the like amount to the satisfaction of the arresting authority upto 16.06.2026.
11. It is made clear that the present interim protection in the form of transit bail
has been granted to the petitioner only in order to enable her to approach the Court of competent jurisdiction for anticipatory bail on merits.
12. In terms of the above observation, this anticipatory bail application stands
disposed of.
