Case taken up before the Lawazima Court.

Learned counsel Mr. S.K. Medhi appears on behalf of the appellants. Heard. Perused the records.

Perusal of the instant case record reveals that the previous Lawazima Court vide its order dated 12.11.2025 had directed the appellants to adhere to the following directions:-

(i) To take fresh steps for service of notice upon the respondent Nos. 42, 43, 44, 47, 48 & 49 by way of speed post mode.

(ii) To obtain necessary instructions regarding the proper and present addresses of respondent Nos. 35, 36, 37, 38, 39, 40 & 41.

Now, in compliance to the above directions of the Lawazima Court, it appears that the appellants have taken fresh steps for service of notice upon the respondent Nos. 42, 43, 44, 47, 48 & 49 by way of speed post mode and the same was issued to the said respondents on 17.12.2025.

But, in regard to the aforesaid notice, it appears that neither the A/D cards nor any un- served notices have been received by the registry as of yet. Further, it has been observed that the postal track consignment details regarding the said notice are not available with the case record. As such, presumption of service could not be drawn.

It has been further observed that the learned counsel for the appellants has submitted a self-certified document (at Flag-"New Add") reflecting the proper and present addresses of respondent Nos. 35 to 41, in compliance with the direction of the previous Lawazima Court dated 12.11.2025.

Since, the appellants have furnished the newly acquired present addresses of respondent Nos. 35 to 41, this Lawazima Court is of the view that the Cause Title of the instant Writ Appeal may be required to be amended to reflect the above mentioned addresses Page No.# 11/11

of the said respondents.

Although the matter is supposed to be laid before the Hon'ble Court for obtaining necessary directions regarding the respondent 35 to 41, the service status of the notice issued to the respondent Nos. 42, 43, 44, 47, 48 & 49 is yet to be received by the registry.

In view of the observations made above, the concerned section is directed to take necessary steps for procuring the postal track consignment details of the notice dated 17.12.2025 issued to the respondent Nos. 42, 43, 44, 47, 48 & 49 and the place the same before the next Lawazima Court.

In the meantime, the appellants may file appropriate application seeking amendment of the Cause title of the instant appeal for reflecting the proper and present addresses of respondent Nos. 35 to 41, if so, advised.

Let the matter be listed before the Lawazima Court again on 13.02.2026.
