Heard Mr. S Borthakur learned counsel for the petitioner. Also heard Mr. N. J. Khataniar,
learned Standing counsel for the Secondary Education.
This writ petition involves the advertisement issued on 26.12.2023 with regard to 1424
vacancies of Post Graduate Teachers in different provincialised schools and 102 vacancies Post
Graduate Teacher in different Government Secondary Schools.
The criteria for selection of Post Graduate Teachers had been laid down in each of the
advertisements at Clause-2 respectively wherein it was stipulated that if any post remain vacant after
publication of the first merit list then maximum two more numbers of merit list would be published. It
was also provided that separate merit lists subject-wise in the case of Post Graduate Teacher will be
published. The affidavit-in-opposition file by the Director of Secondary Education reveals that no

subject-wise and category-wise merit list for the post of "Graduate Teacher" have been published and
therefore, remaining number of vacant posts in the category of post "Graduate Teachers" were not
assessed. There appears to be some error in the language used in the affidavit-in-opposition. After
hearing the matter for some time, this Court gives the liberty to the respondent authority to file an
additional affidavit bringing on record the correct position as may be, on or before 13 th of February,
2026.
The petitioners would be at liberty to file their response to the same before the next date of listing.
List this matter again on 24th of February, 2026.
The issue raised in the writ petition has not been adequately answered or referred to in the
affidavit-in-opposition file by the respondent authority.
Therefore they are directed to bring on record, through the affidavit, specifically as to whether the
merit list for different subjects had been separately prepared prior to the appointment of the selected
candidates being resorted to, whether the said merit list or select list had been duly published as
required under the relevant rules and also whether the second and third lists had been prepared and
published and if not the reasons therefor.
List this matter again on 24th of February, 2026, as a part-hard matter.
