                                          ORDER

Date : 17.10.2025

1. Heard Mr. S. Islam, learned counsel for the applicant. Also heard Mr. K. K. Bhatta, learned counsel for the respondent/Insurance Company.

2. This application has been filed by the applicant/claimant who are the respondent No. 1 in the connected MAC Appeal No. 594/2024 praying for release of 50% of the awarded amount which has been deposited by the Insurance Company before the Registry of this Court in pursuant to the directions of this Court as a condition precedent for stay of execution of the judgment and award which has been impugned in the connected MAC Appeal No. 594/2024.

3. The learned counsel for the respondent/Insurance Company does not raise any objection to the said prayer.

4. Hence, the prayer is allowed.

5. The Registry is directed to disburse the 50% of the awarded amount deposited by the opposite party i.e., appellant/Insurance Company as a condition for stay of the execution of the impugned judgment and award to the petitioner, namely, Mozammal Hussain after proper verification.

6. This interlocutory application is accordingly disposed of.
