Heard Mr. A. Ahmed, learned counsel for the petitioner and Mr. K.K. Parashar,

learned Addl. Public Prosecutor for the State.

This is an application filed under Section 438 read with Section 442 of the

BNSS, 2023 by which the Judgment & Order dated 24.06.2025 passed by the

learned Addl. Sessions Judge, FTC, North Salmara, Abhayapuri, Bongaigaon

dismissing Criminal Appeal No. 8(3)/2024 was challenged by the petitioner and it is

also noticed that in C.R Case No. 207/2018, the respondent No. 2 was acquitted by

Judgment & Order dated 12.07.2025 passed by the Sub-Divisional Judicial

Magistrate (M), North Salmara, Abhayapuri against which the petitioner has filed an

appeal before the learned Sessions Judge, North Salmara, Abhayapuri which had

upheld the said Judgment as stated above.

Issue notice to the respondent No. 2. Petitioner to take steps for service of

notice upon the respondent No. 2 by registered post with A/D to be served through

the jurisdictional court as contemplated under the law.

Call for the Trial Court Records from both the Courts of Addl. Sessions Judge,

FTC, North Salmara, Abhayapuri, Bongaigaon in connection with Criminal Appeal

No. 8(3)/2024 as well as the records from the learned Sub-Divisional Judicial Page No.# 3/3

Magistrate (M), North Salmara, Anbhayapuri in C.R Case No. 207/2018.
