heard Mr. R Borpujari, learned standing counsel, Revenue & Disaster Management Department; Mr. D Nath, learned senior Government Advocate appearing for respondent Nos.2 to 4 and Mr. P.N Goswami, learned Additional Advocate General appearing for respondent No.5, APDCL.

2. The petitioners, 174 (one hundred and seventy four) in nos., have approached this Court stating that they have a common cause of action, to assail an Order dated 01.02.2025 passed by the respondent no. 2, whereby, the petitioners' petitions on the aspects of their status as indigenous landless persons and for settlement has been summarily rejected.

3. Some of the present petitioners had earlier approached this Court to assail eviction notices, dated 15.11.2021, by way of a writ petition, WP(C) No. 8309/2022, wherein there were 207 (two hundred and seven) nos. of writ petitioners. The said writ petition after hearing, was disposed of by a Judgment & Order dated 18.12.2024 with a number of observations and directions.

4. As Paragraphs 16 & 17 of the Judgment & Order dated 18.12.2024 is of import and relevance, the same is quoted hereinbelow in its entirety :-

16. This Court is of the opinion that in order to balance the interest of the landless indigenous families and the competing claims of the State Government, certain appropriate writ, directions and orders are required to be passed.

17. Accordingly, the instant writ petition stands disposed off with the following observation(s) and direction(s):

(i) The Petitioners in the instant writ petition have failed to show that they have a right to settlement over the plot of land ad measuring 864 Bighas 2 Kathas 11 Lechas corresponding to 285 Acres situated at No.3 Chitalmari under Borsola Mouza of Dhekiajuli Revenue Circle, Sonitpur. The above observation is based upon the reading of Rules 15 and 16 of the Settlement Rules read with Clauses 1.14 and 1.15 of the Assam Land Policy, 2019.

(ii) The Petitioners who are indigenous landless families have a right to be considered for settlement as per the Assam Land Policy, 2019 in respect to other Government waste lands subject to fulfilling the criteria laid down in the Assam Land Policy, 2019.

(iii) It is also the opinion of this Court that apart from the present petitioners, other families who were resident prior to the eviction on 03.09.2022 would also be entitled to be considered for settlement of other Government waste lands, subject to fulfilling the criteria laid down in the Assam Land Policy, 2019.

(iv) Accordingly, this Court grants liberty to the Petitioners to submit representations enclosing application for settlement already filed or Page No.# 25/30

application filed seeking settlement with all credentials with 30 days from the date of the instant judgment. The said representations along with the enclosures be filed before the District Commissioner, Sonitpur.

(v) The District Commissioner, Sonitpur is also directed to issue a notice in the Notice Board of his office wherein the representations would be received.

(vi) The District Commissioner, Sonitpur is further directed to issue a notice informing all concerned other than the Petitioners in the Notice Board of his office calling them to submit representations along with all documents, if they desire to avail the rehabilitation in the land specifically reserved for that purpose.

(vii) The District Commissioner, Sonitpur is directed to give the Petitioners as well as those other persons who submit representations a personal hearing or through their authorized representative.

(viii) Upon hearing, the District Commissioner, Sonitpur shall pass appropriate orders to the effect as to whether the petitioners or the other persons who have submitted representations are indigenous landless families of Assam. On the basis of the said opinion, the District Commissioner shall also in consultation with the Revenue Department of the Page No.# 26/30

Government of Assam pass appropriate orders allotting certain specific area of land to those indigenous landless families from the land earmarked in Dag No.378 of Nisalamari village, under Borsola Mouza, Sonitpur, Assam.

(ix) It is further observed and directed that in the circumstance, adversial orders are passed against the Petitioners as well as the other persons, who have submitted representations, the District Commissioner, Sonitpur shall not take coercive action against them for a period of 30 days from the date of passing of the adversial order(s). It is further directed that the orders so passed shall be duly displayed in the Notice Board in the Office of the District Commissioner, Sonitpur.

(x) It is further directed that the status quo in respect to the possession of the land as on date shall be maintained till the exercise is completed as mentioned in Clauses (viii) and (ix) hereinabove.

(xi) The Revenue Department of the Government of Assam is directed to facilitate all such assistance to the District Commissioner, Sonitpur to comply and give effect to the above directions.

5. After perusal of the observations and directions made in paragraph 16 & 17, this court prima facie found the impugned order dated 01.02.2025 to have been passed in disregard to the observations and directions made in the judgment and order dated 18.12.2024 and Page No.# 27/30

accordingly, as an ad interim measure, the operation of the impugned order was stayed till the returnable date. However, leave was granted to the respondent authorities to proceed strictly in terms of the observations and directions made in the judgment and order dated 18.12.2024, notwithstanding the pendency of the present writ petition.

6. Mr. Borpujari, learned counsel representing the District Commissioner submits that a fresh process has been initiated by issuing notice to the petitioners and the interested persons to submit their relevant documents to show that they are indigenous people, as directed by this court under its order dated 18.12.2024.

7. Mr. Bhuyan learned counsel for the petitioners also submits that the petitioners have received such notices and some of the petitioners have submitted their documents and others are in the process of filing such documents in terms of the notice issued.

8. In the aforesaid backdrop, Mr. Borpujari, learned counsel submits that as the petitioners are in receipt of fresh notice and on the basis of their reply a fresh order is required to be passed, the District Commissioner may be allowed to pass a fresh order strictly in accordance with the judgment and order dated 18.12.2024 passed in WP(C) No.8309/2022.

Mr. Bhuyan, learned counsel for the petitioners' submits that as the petitioners have been served with fresh notices and on the basis of their reply, a fresh order is required to be passed, he will have no objection if the District Commissioner is allowed to pass fresh order subject to protection of their rights in the interregnum.

10. Considering the matter in entirety including the submissions Page No.# 28/30

made by the learned counsel for the parties, more particularly, taking note of this court's interim order dated 25.02.2025, whereby leave was granted to proceed afresh, notwithstanding pendency of this writ petition and that the District Commissioner has already started a fresh proceeding on the basis of such leave, the prayer stands allowed. Accordingly, the District Commissioner is permitted to pass a fresh order strictly in terms of the order dated 18.12.2024 passed in WP(C) 8309/2022.

11. This court is also of the opinion that in view of the subsequent development, the impugned order dated 01.02.2025 loses its force and relevance, except the interim settlement proposal made by the District Commissioner.

12. At this stage, Mr. P.N. Goswami, learned Additional Advocate General appearing for APDCL, referring to the impugned order of the District Commissioner, contends that the District Commissioner has balanced the equity and decided to allow APDCL to start the solar project, which is very important for the State of Assam, by protecting the right of those persons who are occupying a portion of the land over 220 acres by relocating them in other lands to facilitate the start of the important project till the final decision is taken. Accordingly, Mr. Goswami, learned Addl. Advocate General submits that such an important project of national interest should be allowed to be started without disturbing the rights of the petitioners and he gives an undertaking in the court on behalf of the APDCL that the APDCL will not take recourse to eviction of any dwelling house situated, for the purpose of starting of the solar project till a firm decision is taken by Page No.# 29/30

the District Commissioner, in terms of the judgment and order dated 18.12.2024.

13. In the considered opinion of this court, proposal of APDCL is an equitable proposition inasmuch as the Deputy Commissioner, as reflected in the impugned order, had already directed the Circle Officer to identify the families who are encroaching government land by constructing houses within 220 acres of the allotted land and shift the houses temporarily to any government khas or ceiling surplus land outside the solar power project plant area. It was also decided that the case of the families shifted temporarily, will be taken up together with all other persons as directed by this court.

14. In the considered opinion of this court, such course of action is a balanced one, more particularly, taking note of the determination made by this court in its judgment and order dated 18.12.2024, as regards the right of the petitioner at para 17(i) & (ii) as quoted hereinabove.

15. Accordingly, leave is granted to the APDCL to start the solar project within the 220 acres of allotted land in question, however, subject to the condition that the petitioners shall not be evicted from their dwelling houses till they are shifted temporarily to any government khas and ceiling surplus land as decided by the District Commissioner i.e. identify the families within this 220 acres of the land and to settle them in an alternative land till final decision is taken by the District Commissioner.

16. The leave granted to APDCL is subject to final order that may be passed by the District Commissioner on the basis of fresh proceeding initiated.

17. It is needless to say that the interim arrangement proposed to be made by the District Commissioner for a portion of land over 220 acres by relocating some of the persons shall be subject to the final decision that may be taken by the District Commissioner after fresh consideration. It is also clarified that the present order shall not be a bar to the petitioners to raise their grievances before the appropriate forum, in the event they are aggrieved by the fresh decision that may be taken by the District Commissioner, in terms of the fresh proceeding, initiated after grant of leave by this court under its order dated 25.02.2025.

18. With the aforesaid observations and determination, the writ petition stands closed.
