The petitioners, 174 [one hundred and seventy four] in nos., have approached this Court stating that they have a common cause of action, to assail an Order dated 01.02.2025 passed by the respondent no. 2, whereby, the petitioners' petitions on the aspects of their status as indigenous landless persons and for settlement has been summarily rejected.

3. Some of the present petitioners had earlier approached this Court to assail eviction notices, dated 15.11.2021, by way of a writ petition, W.P.[C.] no. 8309/2022, wherein there were 207 [two hundred and seven] nos. of writ petitioners. The said writ petition after hearing, was disposed of by a Judgment & Order dated 18.12.2024 with a number of observations and directions.

4. As Paragraphs 16 & 17 of the Judgment & Order dated 18.12.2024 is of import and relevance, the same is quoted hereinbelow in its entirety :-

16. This Court is of the opinion that in order to balance the interest of the landless indigenous families and the competing claims of the State Government, certain appropriate writ, directions and orders are required to be passed.

17. Accordingly, the instant writ petition stands disposed off with the following observation(s) and direction(s):

(i) The Petitioners in the instant writ petition have failed to show that they have a right to settlement over the plot of land ad measuring 864 Bighas 2 Kathas 11 Lechas corresponding to 285 Acres situated at No.3 Chitalmari under Borsola Mouza of Dhekiajuli Revenue Circle, Sonitpur. The above observation is based upon the reading of Rules 15 and 16 of the Settlement Rules read with Clauses 1.14 and 1.15 of the Assam Land Policy, Page No.# 24/27

(ii) The Petitioners who are indigenous landless families have a right to be considered for settlement as per the Assam Land Policy, 2019 in respect to other Government waste lands subject to fulfilling the criteria laid down in the Assam Land Policy, 2019.

(iii) It is also the opinion of this Court that apart from the present petitioners, other families who were resident prior to the eviction on 03.09.2022 would also be entitled to be considered for settlement of other Government waste lands, subject to fulfilling the criteria laid down in the Assam Land Policy, 2019.

(iv) Accordingly, this Court grants liberty to the Petitioners to submit representations enclosing application for settlement already filed or application filed seeking settlement with all credentials with 30 days from the date of the instant judgment. The said representations along with the enclosures be filed before the District Commissioner, Sonitpur.

(v) The District Commissioner, Sonitpur is also directed to issue a notice in the Notice Board of his office wherein the representations would be received.

(vi) The District Commissioner, Sonitpur is further directed to issue a notice informing all concerned other than the Petitioners in the Notice Board of his office calling them to submit representations along with all documents, if they desire to avail the rehabilitation in the land specifically reserved for that purpose.

(vii) The District Commissioner, Sonitpur is directed to give the Petitioners as well as those other persons who submit representations a personal hearing or through their authorized representative.

(viii) Upon hearing, the District Commissioner, Sonitpur shall pass appropriate orders to the effect as to whether the petitioners or the other persons who have submitted representations are indigenous Page No.# 25/27

landless families of Assam. On the basis of the said opinion, the District Commissioner shall also in consultation with the Revenue Department of the Government of Assam pass appropriate orders allotting certain specific area of land to those indigenous landless families from the land earmarked in Dag No.378 of Nisalamari village, under Borsola Mouza, Sonitpur, Assam.

(ix) It is further observed and directed that in the circumstance, adversial orders are passed against the Petitioners as well as the other persons, who have submitted representations, the District Commissioner, Sonitpur shall not take coercive action against them for a period of 30 days from the date of passing of the adversial order(s). It is further directed that the orders so passed shall be duly displayed in the Notice Board in the Office of the District Commissioner, Sonitpur.

(x) It is further directed that the status quo in respect to the possession of the land as on date shall be maintained till the exercise is completed as mentioned in Clauses (viii) and (ix) hereinabove.

(xi) The Revenue Department of the Government of Assam is directed to facilitate all such assistance to the District Commissioner, Sonitpur to comply and give effect to the above directions.

On perusal of the observations and directions made in Paragraphs 16 & 17 above, it is discernable that the petitioners in W.P.[C.] no. 8309/2022 and other similarly situated persons were allowed to submit petitions along with all the supporting documents if they would desire to avail rehabilitation. The District Commissioner, Sonitpur was directed to give the petitioners and all other applicants, who submitted petitions, a personal hearing. It was further directed that upon hearing the District Commissioner should pass appropriate orders on the aspect as to whether the petitioners or the other applicants who had submitted petitions were indigenous landless families of Assam. It was further directed that on the basis of the such Page No.# 26/27

opinions, the District Commissioner shall also, in consultation with the Revenue Department of the Government of Assam, would pass appropriate orders allotting certain specific area of land to those indigenous landless families from the land earmarked in Dag no. 378 of Nisalmari Village under Borsola Mouza, Sonitpur, Assam. A direction has also been made to the effect that if adversial orders are passed against the petitioners and other applicants who had submitted their petitions, the District Commissioner should not take coercive action against them for a period of 30 [thirty] days from the date of passing of the adversial orders.

6. It was in deference to the Judgment & Order dated 18.12.2024, the impugned order has been passed by the District Commissioner on 01.02.2025. In the Order dated 01.02.2025, it has been recorded that the petitions were received from the petitioners and other applicants and they were heard in person. It has been observed that during hearing the petitioners were found to have submitted several documents in support of their claims for settlement. In the impugned order, it has been observed that sufficient amount of time would be required for a proper verification on field regarding the status of encroachment of land by the petitioners and also for scrutiny of authenticity of the documents submitted in order to establish the landless and indigenous status of all the petitioners and applicants. By observing so, the District Commissioner has decided to hand over a parcel of land measuring 220 Acres at No. 3 Chitalmari Village which appears to be out of 285 Bighas, as referred to in sub-para [1] of Paragraph - 17 of the Judgment & Order dated 18.12.2024 [supra], by summarily rejecting the petitioners' petitions with regard to their claim as landless indigenous persons and for settlement in areas of land in respect of those petitioners who are found to be indigenous landless persons after the hearing.

7. Issue notice, returnable on 12.03.2025.

8. As Ms. Mahanta, learned Standing Counsel, Revenue & Disaster Management Department has appeared and accepted notice for the respondent no. 1; Mr. Nath, learned Senior Government Advocate, Assam has appeared and accepted notices for the respondent nos. 2-4; and Mr. Pathak, learned Standing Counsel, APDCL has appeared and accepted notice for the respondent no. 5, formal notices need not be issued to the said respondents. Mr. Bhuyan, learned counsel for the petitioners shall furnish requisite nos. of extra copies of Page No.# 27/27

the writ petition along with the annexures, to Ms. Mahanta, Mr. Nath and Mr. Pathak by tomorrow.

9. The impugned order is found to have been passed prima facie in disregard to the observations and directions made in the Judgment & Order dated 18.12.2024. In such view of the matter, it is observed, as an ad-interim measure, the operation of the impugned order shall remain suspended till the returnable date.

10. Mr. Nath, learned Senior Government Advocate, Assam has submitted that a leave may be granted to the respondent authorities including the respondent no. 2 to proceed strictly in terms of the observations and directions made in the Judgment & Order dated 18.12.2024, notwithstanding the pendency of this writ petition.

11. Finding such prayer for leave reasonable in the interest of both the parties, such leave is allowed.
