Heard Mr. S. Ahmed, the learned counsel appearing on behalf of the petitioner.

2. This is an Appeal under Section 384 of the Indian Succession Act challenging the judgment and other dated 04.11.2024 passed by the learned District Judge, Morigaon in Misc.(Succession) Case No.5/2022 whereby the succession certificate which was sought for by the petitioner was rejected.

3. The instant Appeal being the first Appeal is admitted.

4. Issue notice returnable by 4 (four) weeks.

5. The petitioner is directed to effect service upon the respondent Nos.1 to 9 by registered post with A/D as well as through usual process within 3 days.

6. Call for the records.
