Heard Mr. J. Hussain, learned counsel appearing for the petitioner. Also

heard Mr. R. J. Baruah, the learned APP for the State of Assam.

2. This is an application under Section 442 read with Section 438 of BNSS,

2023, assailing the impugned Judgment and Order dated 26.09.2023, passed by

the learned Sessions Judge Kamrup, Amingaon in Criminal Appeal No. 23/2018,

dismissing the appeal and thereby upholding the impugned Judgment and Order

dated 27.11.2018, passed by the learned CJM, Kamrup, Amingaon in CR. Case

No. 13028/2013, convicting the petitioner to undergo Simple Imprisonment for

1 (one) month under Section 279 of IPC and simple imprisonment of 6 (six)

months under Section 304(A) of IPC.

3. Admit the Revision Petition.

4. Registry to call for the TCR in the instant case from the learned Court of

CJM, Kamrup (M).

5. Ms. R. Choudhury, learned Amicus Curiae is present for the respondent

No. 2.
