learned counsel appearing for the applicant. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor.

This is an application under Section 430 of BNSS praying for suspension of sentence against the impugned judgment dated 05.09.2024 passed in Criminal Appeal No. 9(2)/2024 by the learned Sessions Judge, Lakhimpur, North Lakhimpur as well as the judgment and order dated 11.03.2023 passed by the learned Additional Chief Judicial Magistrate, Lakhimpur, North Lakhimpur in GR Case No. 698/2019 convicting the applicant/petitioner under section 279 IPC to undergo RI for four months with fine in default stipulation.

After hearing the learned counsel for both sides and on perusal of the documents annexed with the application, operation of the judgment dated 05.09.2024 passed in Criminal Appeal No. 9(2)/2024 by the learned Sessions Judge, Lakhimpur, North Lakhimpur as well as the judgment and order dated 11.03.2023 passed by the learned Additional Chief Judicial Magistrate, Lakhimpur, North Lakhimpur in GR Case No. 698/2019 shall remain suspended till disposal of the Revision Petition.

Accordingly, the Interlocutory Application stands disposed of.
