The present petition is filed assailing a Judgment and Sentence dated 15.12.2009 passed by the learned Additional Chief Judicial Magistrate, Dhubri in GR DBB 123/02, whereby the appellants were convicted under Section 406 of IPC and sentenced to undergo Simple Imprisonment for 1 (one) year and also to pay a fine of Rs. 500/- in default SI for one month. The further challenge is a Judgment and Order dated Page No.# 2/2

07.12.2010 passed by the learned Sessions Judge, Dhubri in Criminal Appeal No. 15(4)/2009, whereby the aforesaid appeal was dismissed with modification of sentence.

None appears for the petitioner on call.

Accordingly, Ms. M. Barman, learned counsel is appointed as Amicus Curiae to assist this Court.
