03.06.2024 Heard Ms. RD Mozumdar, learned counsel for the appellant, who has preferred this appeal under Section 173 of the Motor Vehicle Act, 1988 against the judgment and award dated 28.02.2024 passed by the learned MACT No. 1, Kamrup (M) in MAC Case No. 1404/2017. By the said judgment, an amount of Rs.14,95,200/- along with interest has been awarded in a death case.
2. The ground of appeal have been structured that the liability should have Page No.# 3/3
been saddled not on the Insurance Company but also on the owner of the vehicle inasmuch as, there were findings regarding violation of the policy conditions. Further grounds have been raised on the quantum of the amount. It is also contended that the learned Tribunal would not have the jurisdiction and power to make an observation regarding pay and recovery which has been seen to be exercised by the Hon'ble Supreme Court in terms of Article 142 of the Constitution of India.
