Heard Mr. D. Saikia, learned Advocate General of Assam assisted by Mr. D. Nath, leavened Senior Government Advocate, Assam for the applicant.

We have perused the affidavit filed by the applicant with regard to the notice on the opposite party No.1 by dasti service. A perusal of the same indicates that the opposite party No.1 refused to accept notice in presence of the Headmaster and the Ward Member of 1 No. Khumtai Model L.P. School on 07.01.2024.

In that view of the matter, notice on opposite party No.1 shall be deemed to be completed.

After hearing the learned Advocate General, Assam appearing on behalf of the applicant we direct that the impugned judgment and order dated 30.01.2023 passed in WP(C) No. 3245/2021 shall remain suspended till the next date.

List the matter after 4(four) weeks.
