Date : 10.01.2024 Heard Mr. R. Sarma, learned counsel for the applicant.

This interlocutory application has been preferred by the petitioner under Section 389 of the Code of Criminal Procedure, 1973 praying for suspension of the Page No.# 2/2

sentence imposed on the petitioner by the Judgment and Order dated 18.02.2020 passed by the learned Judicial Magistrate First Class, Kamrup(M) in C.R. Case No. 1858/2018 which has been upheld in Criminal Appeal No. 41/2020 by the Court of Additional Sessions Judge No. 1, Kamrup(M) by the judgment and order dated 30.09.2023 which is impugned by the present petitioner by preferring a criminal revision petition which has been registered as Criminal Revision Petition No. 8/2024.

Issue notice to the respondents.

The petitioner shall take steps for issuance of notice to the respondents by registered post with A/D within three days from the date of this order, returnable after three weeks.

As the petitioner is on bail granted by the Trial Court as well as the First Appellate Court, the operation of the sentence imposed on the present petitioner by the impugned order shall remain suspended till the returnable date.
