In the present Contempt Case, one M.H. Choudhury, Zonal Joint Registrar, Cooperative Society, Jorhat was impleaded as respondent contemnor.

Notices were issued to the respondent contemnor by this Court on 14.08.2023. It is seen from the Office Note dated 01.05.2024 that the notices was returned unserved with postal remark "refuse return to sender". The respondent could not have refused to receive notice issued from this Court, wherein, he was impleaded as respondent.

Accordingly, to have a better understanding of the matter, Mr. S.K. Talukdar, learned Standing counsel, Cooperative Department was requested to be present when the matter is taken up today.

Accordingly, Mr. S.K. Talukdar, learned counsel being so present, he is requested to enquire as to the fact whether the said notice was refused by the respondent.

As indicated in the postal report, the said respondent shall also apprise this Court on the next date of listing as to why he had issued the communication dated 05.08.2023 which is purportedly contended to be in violation of the direction passed by this Court vide judgment and order dated 25.07.2023 in WP(C) 4083/2023.

Registry to list this matter again on 16.08.2023.
